When a private citizen or business fails to follow the law, there are consequences. But when cities and counties do the same, they often face little to no accountability. Across Texas, we’ve seen government entities ignore legal requirements—whether by failing to respond within mandated timeframes or by doing things like imposing unlawful costs on landowners and developers.
And when landowners fight back? The only recourse is often a lawsuit—a process that government entities intentionally drag out, knowing that most individuals and businesses can’t afford the time and expense of prolonged litigation. It’s a strategy designed to make landowners give up, rather than get justice.
This pattern of blatant disregard for the law is frustrating not only to TLDA members but also to several Texas legislators. That’s why we’re actively working this legislative session to push for reforms that:
- Hold cities and counties accountable when they ignore or violate the law.
- Prevent local governments from exploiting endless appeals to wear down landowners in court.
Texans deserve a legal system where the law applies equally to everyone—government entities included. Our legislative efforts aim to bring balance, fairness, and real consequences for those who abuse the system.
